Navigating a Workers’ Compensation (WCB) Internal Appeal and a Workers’ Compensation Appeals Tribunal (WCAT) appeal can be complex, time-consuming, expensive, and unfamiliar for many employers—particularly businesses that may not have experience with employment related appeals. Appeals involve detailed legislation, procedural rules, and, in many cases, new or additional evidence. This goes well beyond the day-to-day claims and return-to-work processes most employers are used to managing.
Beginning in 2024, OEA NS was no longer was able to provide representation for employers at the WCB Internal Appeals level or at WCAT. While many employers may choose to retain legal counsel, this representation must be paid for out of pocket. By contrast, workers have access to free legal representation funded through the Accident Fund, which can create an imbalance for employers navigating the appeal system on their own.
