Employers fund Nova Scotia’s workers’ compensation system, yet many don’t have access to the same level of support and representation as workers when navigating appeals.
Since 2024, OEA NS has no longer been able to represent employers at the appeals level. Employers must either navigate a complex process on their own or pay out of pocket for legal counsel, while workers continue to have access to representation funded through the system employers pay into.
The province’s Department of Labour, Skills and Immigration is reviewing the Workers’ Compensation Appeals System through upcoming public engagement sessions and a call-for-comment survey.
Employer input through this review is critical
Employers have shared that the appeals system is complex, costly and imbalanced.
Appeals involve detailed legislation, strict timelines and formal procedures, and many employers do not have the in-house expertise or resources to manage the process effectively.
Decisions at the appeals level can also directly affect assessment rates and overall costs. Share your voice through this review to help ensure employer experiences are understood and considered in any future changes.
